Updates include the following:
1. ADVICE-40-004-08: Advice note on non-conforming product (Revised)
The Advice note was revised to specify that Small COC enterprises do not need to have procedures in writing.
2. ADVICE-40-004-09: Advice note on minor components (Revised)
Based on several feedback received from stakeholders since the publication of the previous version of the Directive, this Advice Note was revised to generically address all applicable timber legality legislations, eliminating the previous emphasis on the EUTR and fully harmonising with existing timber legality legislation in the EU, US and Australia. Also, the timelines for the complete phase out of products containing minor components are shortened, but also further differentiated concerning production of products containing minor components and sale of stocks. Attention to this change in the timelines because it affects not only the companies in countries where timber legality legislation exist, but all certificate holders using minor components.
The revised advice note conforms with the scope of each timber legality legislation. In the case of the EUTR for example, where the scope of the legislation refers to “placing on the market”, FSC certificate holders shall not place FSC certified products containing minor components on the market. Organizations required to comply with Lacey Act that cover commercial activities other than placing on the market (taking, harvesting, processing, transporting, selling and exporting of wood and wood products) and the Australian law that refers to importing and processing of products, the use of minor components is no longer allowed in any of these activities.
The manufacturing of products containing minor components are still allowed until December 31, 2013 in Countries and for products outside the scope of these timber legality legislations.
This clarification is just for information (non-normative) and its only purpose is to support understanding of the requirements. For further questions, please contact PSU.
